1. Overview

This website, comfywarm.com, is operated by Comfy Warm ("we", "us", "our"). These Terms of Service ("Terms") apply to everyone who visits the site or buys from us. By using the site or placing an order you agree to these Terms, our Privacy Policy, our Shipping Policy and our Return & Refund Policy. If you do not agree, please do not use the site.

Our store is hosted on Shopify. Payments are processed by our payment providers and are subject to their terms.

2. Eligibility

You must be at least the age of majority where you live, or have permission from a parent or guardian, to place an order. You agree to provide accurate, current and complete information when you order.

3. Products and descriptions

We make every effort to describe and show our products accurately. Colors can look different depending on your screen, and minor variations in fabric and dimensions are normal. If a product is not as described, you can return it under our Return & Refund Policy.

4. Prices and availability

  • All prices are shown in US dollars unless your currency is displayed otherwise at checkout.
  • Prices, offers and bundles may change at any time, but changes never affect an order you have already placed.
  • If a product is listed at an incorrect price due to an error, we will contact you before shipping and give you the option to proceed at the correct price or cancel for a full refund.
  • Products are subject to availability. If an item you ordered is unavailable, we will refund you in full.

5. Orders and payment

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example if we suspect fraud or cannot verify payment; if your payment was taken, we refund it in full. You confirm that you are authorized to use the payment method you provide.

6. Shipping, returns and warranty

Shipping costs, countries, processing and delivery times are set out in our Shipping Policy. Return windows (a 90-night trial for the ComfyWarm Wearable Heated Blanket and 30 days for all other products), refunds and our 1-year limited warranty are set out in our Return & Refund Policy. Nothing in these Terms limits any rights you have under applicable consumer protection law.

7. Safe use of heated products

Please read and follow the instructions supplied with the ComfyWarm Wearable Heated Blanket. In particular: use only the supplied controller and power adapter; do not use it on infants, young children, or anyone who cannot sense heat or operate the controller; do not use it while it is folded or bunched; remove the controller before washing and follow the care instructions on the care label; and stop using it if the cord, controller or fabric is damaged. If you are pregnant, have diabetes, poor circulation or any medical condition, ask your doctor before use. Our products are not medical devices and are not intended to diagnose, treat or cure any condition.

8. Reviews and user content

If you submit a review, photo or other content, you confirm it is your own, truthful and based on your genuine experience, and you grant us a non-exclusive, royalty-free license to display it on our site and marketing. We may remove content that is unlawful, offensive or misleading.

9. Intellectual property

All content on this site, including text, images, logos and design, belongs to us or our licensors and may not be copied or used without our written permission.

10. Third-party links and services

The site may link to third-party websites or use third-party services. We are not responsible for their content or practices; their own terms apply.

11. Disclaimer

Except for the express warranty in our Return & Refund Policy and any rights you have by law that cannot be excluded, the site and products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim relating to a product is limited to the amount you paid for that product. This does not limit liability that cannot be limited by law, including for death or personal injury caused by negligence.

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the site or our products.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, except where the consumer laws of your country of residence give you rights that cannot be waived.
